Does anyone think it may be useful to create a list where we know there is a strong defense of the need to overrule? Perhaps a topic where we have the best 5 or 6 six solvency cards that say why it really needs to be overruled

"has there been a Boerne v. Lemon debate. I've looked pretty hard and found nothing that says overrule/overturn Boerne. The closest is the one card Steve has that says the decision was decided wrongly. We have evidence for Lemon - solvency evidence. If the goal is to give the AFF some good choices, I don't see how harms evidence alone is a good choice. Furthermore, Lemon has pretty good harm areas as well, and is probably as protected against the agent cp.

People will approve Boerne because they want a religious freedom aff, and find out there isn't much there (especially when compared to Lemon). Yes, there are other harms areas (SOP/civil rights), but these are still rights impacts. And, this doesn't deal with the lack of a solvency advocate. I'd be curious to hear what people have to say about Boerne. I'd guess most know nothing and are taking Steve's word on this case."
